Cordoba teachers who need to care for a minor child with type 1 diabetes face repeated denials of reduced working hours by the Territorial Delegation of Educational Development and Vocational Training. CSIF Córdoba has conveyed its concern to the territorial delegate for the sector, Diego Copé, and has asked him to review the criteria used to decide these requests, especially when there are reports from the specialists following the minor that certify the need for direct, continuous and permanent care. Type 1 diabetes mellitus is a chronic and serious illness that requires continuous monitoring of glucose levels, administering and adjusting insulin, controlling the effects of food and physical activity and responding quickly to decompensations such as severe hypoglycemia or loss of consciousness, which can seriously compromise the minor's health, according to the union.

A ruling that supports the reduction

CSIF notes that legislation and case law support this claim. Among them it cites a ruling by the Superior Court of Justice of Andalusia (TSJA) this year that upheld the decision of Contentious-Administrative Court number 3 of Córdoba which recognized a teacher's right to reduce her working hours by 50% because the medical reports certified the need for specific care of her minor daughter with type 1 diabetes. The union asks the Territorial Delegation to explain what medical, legal and administrative criteria it applies to deny these permits and to review the decisions in accordance with the rules, using the specialist's reports as a reference. It also requests that each request be assessed individually, without the minor's schooling or the absence of hospitalization becoming automatic impediments. When the specialist certifies the need for care, CSIF calls for at least the minimum reduction of 50% to be granted and, depending on the circumstances, the minor's age and clinical situation, for it to be extended within the foreseen margin of up to 99%. The union expresses its surprise because, it states, this problem is not occurring in other Andalusian provinces, where permits are generally granted without objection. For CSIF Educación Córdoba, the priority must be the protection of the health, safety and best interests of minors with type 1 diabetes, as well as respect for teachers' labor rights. The organization demands homogeneous criteria, reasoned responses and legal certainty so that families in comparable medical situations do not receive different treatment, and announces that it will continue to demand solutions from the educational Administration.
